How many of the items above were allowed to be covered up, missed, or ignored by Senán Allen’s report — which:
- Failed to review the Central Bank disclosures (per Committee member communication). How many of the items above can be tied to the failure of the Central Bank as a regulator?
- Failure to interview corroborating witnesses
- Failure to acknowledge that team members supported the issues identified by the whistleblower
- Failed to acknowledge that at least one expert support team member resigned as a result of the process, and supported the whistleblower in writing
- Acknowledged the accuracy of at least one of the disclosures, which he also ignored in his report
- Some disclosures are “live to this date”
- Mr Allen and Dáil Clerk (Mr Finnegan) refused to provide the whistleblower with an opportunity to respond to his report before publishing, in accordance with inquiry guidelines, and ignored the rebuttal report submitted November 25, 2015
- The Taoiseach at the time, Enda Kenny, was also informed of the issues with the HOO investigating themselves in July 2015. Did he do anything? Mr Allen actually bragged about access to “the Taoiseach’s private bathroom”
Concerns raised about the Inquiry in mid 2014 and then the S Allen process were evident to all as evidenced below and ignored or to quote our current EU Commissioner “nothing to see here” on Cork’s Red FM regarding the protected disclosures (many of which are still active in 2026)
- June 2014 – Stephen Donnelly, TD resigned as a Committee bank, as reported in the media: “First, the banking inquiry is, under law, an Oireachtas Inquiry, not a Cabinet Inquiry,” he wrote”. “The Government could set the terms of reference, pass the final report, and ensure they would know what the members of the banking inquiry would do”. The Govt tried and failed to remove McSharry in same article
- April 4, 2015 – Pearse Doherty, TD wrote to the Bank Inquiry Committee (the “Committee”) about his concerns regarding the Central Bank documents and flow of information
- July 16, 2016 – Marc Mc Sharry wrote to Dail Clerk, Peter Finnegan, demanding an “Independent Inquiry” of the protected disclosures and “for the Committee to be kept informed”
- July 28, 2016 – McSharry wrote to Taoiseach, Enda Kenny expressing his concerns and demanding an independent inquiry
- Sept 8, 2015 – McSharry wrote to all committee members about his concerns over the Senan Allen report, his failure (refusal) to investigate the central bank disclosures, refusal to interview corroborative witnesses, his demeanor and tone to the whistleblower. Not identified in his memo as he probably did not know at the time, is how Mr Allen carefully ignored the fact he “agreed with at least one of the disclosures” in his memo as evidenced in transcripts.
- Oct 14, 2015 – McSharry wrote to all committee members with a very detailed memo on (a) his concerns re Allen report and (b) the banking crisis
- Nov 25, 2015 – the whistleblower who was not provided with an opportunity to comment on the Allen report, provided a comprehensive 18-page rebuttal that was shared with the Dail Clerk and all Committee Members
- January 2016 – Pearse Doherty TD and Mr Joe Higgins TD did not sign the final inquiry report. Mr McSharry, in our opinion, given all the concerns raised over months signed it under influence from his party.
